Intent and Purpose: The primary intent is to establish a curated, safe sanctuary that directly addresses the unique historical, cultural, physical, and mental health challenges faced by gay Black and African American men. By creating a specialized space, the business aims to counter the lingering effects of historical exclusion, societal prejudice, and minority stress.
Constitutional Rights: Under the First Amendment, private commercial entities that provide highly customized, expressive, or curated environments possess rights regarding expressive autonomy and freedom of association.
While the Afri Resort operates as a fully comprehensive gay resort open and welcoming to the gay community, the Afri Bar is a private commercial venture designed specifically to provide tailored, highly specialized experiences, products, and physical environments that directly serve the unique historical, cultural, physical, and mental health needs of gay Black and African American men due to stigmas and discrimination. Pursuant to the First Amendment of the United States Constitution, and as upheld by the Supreme Court of the United States in 303 Creative LLC v. Elenis, 600 U.S. 570 (2023) and Boy Scouts of America v. Dale, 530 U.S. 640 (2000), the Company exercises its constitutional right to expressive autonomy and freedom of association to maintain the integrity of this dedicated, specialized space.
Negotiations for the proposed home of the Afri Bar have faced temporary delays due to circumstances outside our control, including ongoing legal battles, unfair competitive practices, and the current social and political climate. Please rest assured that our vision has not changed. We are completely confident that we will prevail in court, allowing us to resume location negotiations and break ground on construction.
